1. Introduction

Your privacy is important to us. We are not here to collect data but to create a great platform for creators and music lovers! However, to do so, we do need some information from you. This Privacy Policy explains how we collect, use, share and secure your information when you use Songstats and how you are always able to control and update your information. Any information provided by you will only be used in accordance with this Privacy Policy.

2. Our Principles

We are committed to two main principles: Privacy Protection and Transparency.

We are committed to ensure that your privacy is protected. Therefore, we are very careful with user-data, only saving the very least of information we need to be able to fully operate. All data is fully enclosed and encrypted, providing you with the highest level of privacy security possible.

We are committed to ensure that you know exactly why we need your data and what is happening with the information we collect. You should have full control over your information. 3. Subscriptions and Purchases

3.1 Subscriptions and Purchases
The terms and conditions set out in these terms and conditions apply only to Subscriptions taken out directly via our website www.songstats.com (the “Site”). By placing an order for the Subscription, you warrant that: you are legally capable of entering into binding contracts; and you are at least 18 years old.By submitting your payment and other subscription details, you are making an offer to us to buy the Subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your details, at which point we will provide you with access to your Subscription. We reserve the right to reject any offer in our discretion, for any or no reason.

3.2 Prices and Payment
You agree to pay the price at the rate notified to you at the time you take out your Subscription. We may modify the price of any Subscription, remove and/or offer certain other subscription services from time to time. We will always tell you in advance of any increase in the price of your Subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.

When you subscribe you must provide us with complete and accurate payment information. By submitting payment details you promise that you are entitled to purchase a Subscription using those payment details. If we do not receive payment authorisation from the card issuer or bank or any authorisation is subsequently cancelled, we will not accept your order and we may immediately terminate or suspend your access to your Subscription and may in suspicious circumstances contact the card issuer or bank and/or law enforcement authorities or other appropriate third parties.

In addition to the Subscription payment, you are responsible for paying any internet connection or other telecommunications charges that you may incur by accessing the App or using the services available on it. For example, your mobile network operator may charge you for data or roaming services.

It is always possible that, despite our best efforts, the Subscription prices listed on the Site may be incorrectly priced. If we discover a pricing error, we will inform you of this error and we will give you the option of continuing to purchase the Subscription at the correct price or cancelling your order. If we are unable to contact you using the contact details you provided, we will treat the order as cancelled and notify you by email. Please note that if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Subscription to you at the incorrect (lower) price.

3.3 Renewals and Cancellations
After any minimum term or free-trial period specified in the order process your Subscription will automatically renew monthly at the rate notified to you at the time you take out your Subscription. We will take payment using the same card or other payment method that you previously used or supplied to us in the order process.

After any minimum term specified in the order process that applies to your Subscription, you may cancel your Subscription at any time and cancellation will only take effect at the next payment date. There are no refunds for unused parts of your Subscription. You may cancel your Subscription from the Subscription Management screen.

3.4 Cancellation by Us
We may end your Subscription at any time by writing to you if (i) you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due; (ii) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Subscription; (iii) we have reason to believe you have been acting fraudulently.

Cancellation by you if there is a problem with the Subscription Service and Complaints.

We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights.

4. Information We Collect

4.1 Information We Collect
This site is not affiliated with or part of the companies from which we are collecting data, including but not limited to: Spotify, SoundCloud, Beatport, YouTube, Apple Music, and iTunes. The data shown on this website are retrieved directly from the APIs for these services.

All the information we collect is related to providing our services. The information we collect depends on whether you just visit our website without a registration or whether you register with us in order to become part of Songstats. Depending on your preferred use of our website, we may collect and store the following information:

As unregistered visitor of our website, we may collect information about your browser, your location, your surfing behavior, and access statistics.

As a user of our dashboard we may additionally collect some information via the API of the Social Network(s) you connect with when supporting your selected content (to learn about the information provided by other sources, see section 4.2). This information may include: your e-mail address, your name, your age, your friends lists, and the content you like and support.

We also collect the following details for the purpose of completing a transaction: your PayPal Login (but not your password), your address, your bank details and your date of birth.

Moreover, like most online services, we use cookies to help us understand how people are using Songstats, so that we can continue to improve the service we offer. Please see below section 12 to learn about our use of cookies and similar technologies.

4.2 Information provided by your Social Networks
If you connect a Social Account, you will be asked your permission to share certain information from your Social Account(s) with us. This may include your first name, last name, email address in order for us to verify your identity and gender, general location, a link to your Social account profile, your time zone, birthday, profile picture, your "likes" and your list of friends.

This information is collected by the respective Social Network and is provided to us under the terms of the respective Social Network privacy policy. You can control the information that we receive from the respective Social Network using the privacy settings in your respective Social Account.

5. How we use the information we collect

We may use the information that we collect about you for the following purposes:

  • • to identify you as the Owner of Your Content, as the rightholder of your sound-recordings, and/ or other contributions that you make to Songstats;

  • • to provide, maintain, personalize, protect and improve Songstats, your Songstats account, our services, products, and advertising, including those from third parties, for example by providing customized, personalized, or localized content, recommendations, features, and advertising on Songstats;

  • • to publish your public profile with the information you choose to publish publicly, such as your name, photo, links to other social profiles, and actions you take on Songstats or on third-party applications connected to your Songstats account

  • • to provide other users with information regarding people's listening and supporting behavior of their content;

  • • to ensure technical functionality of Songstats, provide you with technical support, develop new products, functions and services, and analyze your use of Songstats, including your interaction with applications, advertising, products, and services that are made available, linked to or offered through the Service;

  • • to communicate with you for Songstats-related updates and notifications or research purposes including via e-mail, notifications, or other messages, which you agree to receive;

  • • to respond to you about any comment or enquiry you have submitted;

  • • to communicate with you, either directly or through one of our partners, for marketing and promotional purposes via e-mail, notifications, or other messages, consistent with any permissions you may have communicated to us (e.g. through your Songstats account settings); whereas you have always the option to opt out from receiving certain messages (see section 8 below);

  • • to enable and promote Songstats, including its features and content as well as products and services made available through Songstats;

  • • to process your payment and payouts and to prevent or detect fraud; all payment verification information is transmitted using industry-standard SSL (Secure Socket Layer) encryption; we comply with the Payment Card Industry Data Security Standard;

  • • to enable age restrictions;

  • • to prevent or take action against activities that are, or may be, in breach of our Terms & Conditions or applicable law, and to enforce this Privacy Policy and our Terms & Conditions otherwise;

  • • to provide you with features, information, advertising, or other content which is influenced by your location and your location in relation to other Songstats users; and

  • • as otherwise stated in this Privacy Policy.

6. How your information is shared

6.1 Sharing by you
By connecting your Songstats account to your Social Network account(s), you allow us to automatically share your activity and activity-related stories with that Network(s), including the content you consume. You understand and agree that such information may be attributed to your Social Network account and may be published on such Social Network. Although this information may be automatically shared by default, we inform you of the controls that you can use to limit the sharing of this information in section 8 below. The Social Network(s) may also provide similar controls.

Songstats also enables you to share a particular item of content or a playlist that you have created, on an individual basis, to your Social Networks, other third party services, other Songstats users, and others

You understand and agree that a Social Network's use of information collected from you (or as authorized by you) is governed by the respective Social Network's privacy policies and your settings on the relevant Social Network, and our use of such information in connection with Songstats is governed by this Privacy Policy and your Songstats account settings.

6.2 Sharing by Songstats
We do not share your information unless one of the following circumstances applies:

We will share personal information with others when we have your consent to do so. For the sharing of any sensitive personal information, we require your explicit opt-in consent.

6.4 Marketing and advertising
We may share information with advertising partners in order to send you promotional communication about Songstats or to show you more personalized content, including relevant advertising for products and services that may be of interest to you, and to understand how users interact with advertisements. The information we share is in a de-identified format (for example, through the use of hashing) that does not personally identify you.

Please see section 13 below to learn about cookies and other technologies that we and third parties use to serve you more relevant ads and your options.

6.5 Service providers and others
We may from time to time share your information with service providers to perform functions and process user data and help provide our Services, consistent with this Privacy Policy. Where a third party processes user data on our behalf (e.g., a hosting service provider), it is subject to security and confidentiality obligations consistent with this Privacy Policy and applicable law. Where a third party processes user data on its own behalf, its processing is subject to its own privacy policy and applicable law, as described before.

6.6 Other sharing
In addition to the above, we may also share your information with third parties for these limited purposes:

  • • to allow a merger, acquisition, or sale of all or a portion of our assets or business; or

  • • to respond to legal process (e.g., a court order or subpoena), if we believe in good faith that it is necessary to do so; to comply with requirements of mandatory applicable law; to protect the safety of any person; to protect the rights and property of Songstats, including to enforce the Terms & Conditions; and to address fraud, security, or technical issues; or

  • • to academic researchers for purposes including statistical analysis and academic study, but only in a de-identified format; or

  • • to publish de-identified or aggregate information about the use of Songstats.

7. Communications with other users

Please note that all personal information you display or communicate using interactive features of Songstats and your Social Networks becomes public information and we are not responsible for any information you choose to make public. We may, but have no obligation to, monitor such traffic via electronic software or otherwise in order to check for obscenity, defamation or abusive language, which we reserve the right to remove at any time. In addition, Songstats cannot be held responsible for any consequences which flow from your decision to communicate or interact with other Songstats users in places or under circumstances which we do not control.

8. Security

We are committed to protecting your information. Since your password protects your user account, you should use a unique and strong password that only you know of, limit access to your computer and browser, and log out after having used Songstats. You should never disclose your password to unauthorized people. In order to prevent unauthorized access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We use certain security measures to help keep your personal information safe. While we take data protection precautions, no security measures are completely secure, and we do not guarantee the security of user information. In the event that we believe that the security of your personal information in our possession or control may have been compromised or could be at risk, we may seek to notify you. If a notification is appropriate, we would endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your e-mail address, we may notify you by e-mail. You consent to our use of e-mail as a means of such notification. If you prefer for us to use another method to notify you in this situation, please contact us!

9. Your preferences and control

We want to give you as much control about your information as possible. Therefore, we provide you with settings to allow you to choose your preferences concerning certain information. You can adjust the settings in your account (go to your Profile page).

Please note that this Privacy Policy does not apply to any third party sites or applications such as your Social Networks, and we cannot control the activities of those sites or applications. You are advised to read the privacy policies of those sites or applications before sharing your information with, or connecting your Songstats account to, any of these third party sites or applications.

We may also use third party services using cookies or similar technologies showing you personalized ads on our behalf. Please see section 12 below to learn how to opt-out of those. Please be aware that even if you opt out of interest-based ads, you may still see ads, which likely are not as appealing to you.

10. Links

We may display advertisements from third parties and other content that links to third party websites. We cannot control or be held responsible for third parties' privacy practices and content. Please read their privacy policies to find out how they collect and process your personal information.

11. Children

Songstats is not intended for use by and not directed to children. Anyone under the age of 13 is not permitted to use Songstats and must not attempt to register an account or submit any personal information to us. We do not knowingly collect any personal information from children under the age of 13 or allow them to register an account. If it comes to our attention that we have collected personal data from a person under the age of 13, we will delete this information as quickly as possible. If you have reason to believe that we may have collected any such personal data, please notify us immediately at support@songstats.com.

12. Accessing and updating your information

You can access most of your information you provide us with through your account and profile page. If you wish to access, change or delete any other personal data we hold about you, or have any question about the information we hold, please contact us at support@songstats.com.

If you wish to delete your account, we will do so within a reasonable period of time, but we may need to retain some of your personal data in order to satisfy our legal obligations, or where we have a legitimate reason for doing so.

13. Cookies and similar technologies

The acceptance of cookies is not a requirement to visit our website. Like most online services, we use cookies to help us understand how people are using Songstats, so that we can continue to improve the service we offer. Moreover, some of our features are only possible if you allow us to set cookies. In this section, we explain our use of cookies, and how you can disable them.

13.1 What are cookies
Cookies are small text files that are placed on your computer by websites that you visit. These text files can be read by these websites and help to identify you when you return to a website. There are "persistent" and "session" cookies. Persistent cookies remain on your computer when you have gone offline, while session cookies are deleted as soon as you close your web browser. 13.2 Songstats cookies
We use our own cookies to recognize you when you visit our website or use our service on your mobile device. This means that you don't have to log in each time you visit, and we can remember your preferences and settings.

13.3 Third Party Cookies / Similar Technologies
In addition to our own cookies, we work with different reputable companies to help us analyze how Songstats is used, and improve our service to deliver the best possible experience. The following companies help us achieve this through use of cookies:

Google Analytics and Google Website Optimizer

Google Analytics and Google Website Optimizer are services provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use our services. Google Web Optimizer uses the same cookies to measure how different users respond to different content. The information generated by these cookies (including your truncated IP address) is transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your and other users' use of our services and providing other functionality related to website activity and internet usage. Please note that Google only receives your truncated IP address. This is sufficient for Google to identify (approximately) the country from which you are visiting our service, but is not sufficient to identify you, your computer or mobile device, individually.

13.4 How to manage your cookies and preferences
Most browsers accept cookies by default. You can use the settings within your browser to control the cookies that are set on your computer or mobile device. However, please be aware that if you deactivate a cookie or if you set your browser to reject cookies, you may not be able to enjoy all of the features of Songstats.

By disclosing any information to us through Songstats, the Website, and our Services, and by using Songstats, the Website and our Services as a registered user, you are consenting to the collection, storage and use of your personal information by us as set out in this Privacy Policy, and you understand and consent to the collection, maintenance, processing and transfer of such information. If you do not consent to the collection, maintenance, processing and transfer of such, then you should not use the Website as a registered user. When you provide your personally identifiable information, it may be used by us and our direct and indirect consolidated subsidiaries for the purposes of, for example but not limited to, providing you services and sending you correspondence, and additionally may be transferred to entities other than our affiliates, which entities may be located in other countries. Each of these countries has different privacy laws that afford varying levels of protection for your personally identifiable information, and such laws may not be as comprehensive as those that exist in the EEA. By registering with Songstats, you consent to our and our direct and indirect consolidated subsidiaries' transmission to, and processing of your information in, any jurisdiction, in accordance with this Privacy Policy.

We have done our best to provide you with clear and comprehensive information about our use of cookies and similar technologies. If you choose to use our service without blocking or disabling cookies or opting out of these technologies (as described above), you will indicate your consent to our use of these cookies and other technologies and to our use (in accordance with this Privacy Policy) of any personal information that we collect using these technologies. 15. Usage Policy

15.1 Usage Policy
You agree to use the Services for non-commercial use and, above all, fairly. The Services are not to be used for commercial purposes. Songstats reserves the right to limit your identification attempts in any month, or cease to provide our Service to you without further notice. We may change, suspend or discontinue any aspect of Songstats at any time, including the availability of any feature, database and/or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without liability. Where these changes or suspensions would amount to a complete termination of the Services you may be entitled to a refund of the reasonable part of any charges paid by you. Continued use of the Application and/or Services may require a download of new releases of software with different functionality and that may have different licence terms.

15.2 Legal Protection and Limitations
You acknowledge that the Songstats Website and Applications (and any other Third Party Applications and/or Sites) licensed by us to you are our property (or that of the relevant third party). You are granted a limited, revocable, non-exclusive, non-transferable (without the right to sublicense) licence to use Songstats or any Third Party Application and/or Site for the purpose of accessing and using the Services. Except as expressly authorized by us, you may not copy, modify, translate, reproduce, distribute, publish, broadcast, perform, display, sell, assign, lease or sub-license that content, in whole or in part. You agree not to disassemble, de-compile, reverse engineer, or otherwise attempt to gain access to the source code of the Application or Services or any Third Party Application and/or Site. You will not copy any part of Songstats or any Third Party Applications and/or Sites or make commercial use of, rent, lease, loan, sell, publish, license, sublicense, distribute, assign or otherwise transfer any part of Songstats or such Third Party Application and/or Site to any person. You agree to not use Songstats to: (i) interfere with, manipulate, or take any actions that may undermine the integrity of any rating system used on the Services; (ii) interfere with or disrupt Songstats or servers or networks, or disobey any requirements, procedures, policies or regulations of networks connected to these; (iii) collect or store personal data about other Users of Songstats; or (iv) harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any other User without their prior explicit consent.

15.3 Changes to the Privacy Policy
We may change this Privacy Policy from time to time by updating this page. Therefore, you should check this page from time to time to ensure that you are happy with any changes.

16. Privacy Policy

16.1 Songstats Privacy Commitment
This is our new privacy policy that covers every Songstats website that links here, and all of the products and services contained on those websites.

  • • We use your information to carry out requests you make of our business.

  • • We only disclose personal information externally to comply with official law.

16.2 Information Songstats Collects And Controls
We only collect the information that we actually need. Some of that is information that you actively give us when you sign up for an account, register for an event, ask for customer support, or buy something from us. We store your name and contact information, but we don't store credit card numbers (except with your permission and in one of our secured payment gateways). When you visit one of our websites or use our software, we automatically log some basic information like how you got to the site, where you navigated within it, and what features and settings you use. We use this information to improve our websites and services and to drive new product development. Sometimes we receive information indirectly. If you ask about our products through one of our referral programs or reselling partners, or sign in to one of our products through an authentication service provider like LinkedIn or Google, they'll pass on your contact information to us. We'll use that information to complete the request that you made. If you engage with our brand on social media (for instance, liking, commenting, retweeting, mentioning, or following us), we'll have access to your interactions and profile information. We'll still have that information even if you later remove it from the social media site. We use your information to provide the services you've requested, create and maintain your accounts, and keep an eye out for unauthorized activity on your accounts. We also use it to communicate with you about the products you're currently using, your customer support requests, new products you may like, chances for you to give us feedback, and policy updates. We analyze the information we collect to understand user needs and to improve our websites and services. We're required to have a legal basis for collecting and processing your information. In most cases, we either have your consent or need the information to provide the service you've requested from us. When that's not the case, we must demonstrate that we have another legal basis, such as our legitimate business interests. You can decline certain kinds of information use either by not providing the information in the first place or by opting out later. You can also disable cookies to prevent your browser from giving us information, but if you do so, certain website features may not work properly. We completely disable third-party cookies from all Songstats websites and products. We limit access to your personal information to our employees and contractors who have a legitimate need to use it. If we share your information with other parties (like developers, service providers, domain registrars, and reselling partners), they must have appropriate security measures and a valid reason for using your information, typically to serve you. The European Economic Area (EEA) provides certain rights to data subjects (including access, rectification, erasure, restriction of processing, data portability, and the right to object and to complain). Songstats undertakes to provide you the same rights no matter where you choose to live. We keep your personal information for as long as it is required for the purposes stated in this Privacy Policy. When we no longer have a legitimate need to process your information, we will delete, anonymize, or isolate your information, whichever is appropriate.

16.3 Information That Songstats Processes On Your Behalf
You own your service data. We protect it, limit access to it, and only process it according to your instructions. You may access it, share it through third-party integrations, and request that we export or delete it. We hold the data in your account as long as you choose to use Songstats Services. After you terminate your account, your data will be automatically deleted from our active database immediately and from our backups within 3 months after that. If you are in the European Economic Area and you believe that someone has entrusted your information to us for processing (for instance, your employer or a company whose services you use), you can request certain actions from us regarding your data. To exercise those data rights, please contact the person or company that entrusted the data to us and we will work with them on your request.

16.4 General
There are some limitations to the privacy we can promise you. We will disclose personal information if it's necessary to comply with a legal obligation, prevent fraud, enforce an agreement, or protect our users' safety. We do not currently honor Do Not Track signals from internet browsers; when a universal standard for processing them emerges, we will follow it. Third-party websites and social media widgets have their own separate privacy policies. Always check the relevant privacy policy before sharing personal information with third parties. You can always contact us to: ask questions about our privacy practices, request a GDPR-compliant Data Processing Addendum, alert us if you believe we have collected personal data from a minor, or ask to have your personal information removed from our blogs or forums. We will contact you to let you know if we make any major changes to our privacy policy, or in the highly unlikely event that we ever decide to sell our business.

17. API Client Terms of Service

17.1 Policy
This site uses APIs from various services including YouTube, SoundCloud, Spotify, Apple Music, Deezer, Facebook, Beatport and Traxsource. This site is in compliance with the privacy policies and terms of service established by the service providers. By signing our privacy policy, you agree to the privacy policies and terms of service established by these partners, and agree to be bound by the Terms of Service listed below for each provider.

17.2 YouTube API Terms of Service
The Songstats API Client accesses, collects, stores, and uses various types of information, including API Data related to channels, to enhance your experience and provide you with personalized services. This information may include, but is not limited to, your name, email address, channel, and usage data. Songstats uses the collected user information to analyze usage patterns, display additional channel analytics, and provide personalized content. If the Songstats API Client accesses or uses Authorized Data, you have the option to revoke access to your data. You can do this through the Google security settings page at: https://security.google.com/settings/security/permissions. This action is in addition to our API Client's standard procedures for deleting stored data. If you have any questions or concerns regarding our API Client's privacy practices, especially with regards to the use of Authorized Data, you can contact us at support@songstats.com. We are committed to addressing your concerns and ensuring the protection of your privacy.
